At the Law Offices of Mike F. O’Brien, we only work on a contingency fee. This means that if we don’t win, we don’t get paid. Injury victims often cannot afford to pay an attorney by the hour. Our contingency fee is the same as most top-quality lawyers in California who handle serious personal injury matters. Additionally, we do not have any up front costs or fees when working with us.

Some personal injury claims do not require a lawyer, however, every potential personal injury claim requires at the very least a consultation with a lawyer. The insurance company is not there to take care of you, whether it is your own company or that of the responsible party.  Their primary goal is to save money…and if they can do that by not paying you what you owe, either on the property damage or the personal injury, they will do it! Attempting to handle a case without a lawyer will very likely result in you getting less that you are owed, and remember…the insurance company pays the attorney’s fee, so it makes all the sense in the world to at least consult with an attorney first.

When it comes to personal injury matters, each case is unique;  there is no such thing as a fixed compensation associated with a given injury. A number of factors contribute to the valuation of your case, including the amount of available insurance, cost of medical bills and percentage of fault. While much of this information is unknown at the time of your injury, it is easier to estimate the value of a claim as your case progresses. At the Law Offices of Mike F. O’Brien, our goal is to gather this information as quickly as possible while protecting you from insurance company tactics used to devalue your claims. In addition, as the founder of the Case Valuation Publication “O’Brien’s Evaluator”, Mr. O’Brien is more qualified than most to evaluate the amount you should receive.

No.  Remember, when you come to consult with me about your case, we are not anticipating a lawsuit. It is an insurance claim against the insurance company. If you loaned your friend some money, and he or she could not pay you back, you might forgive the debt.  But if a multibillion dollar insurance company owes you money, they MUST pay you back under the law. That is our job…to make them pay you what they owe you. And if they don’t? Or if they try to evade responsibility for your injuries and damages? That is when the case goes to court, and we fight to make sure they meet their legal obligation to you.

After an accident, your health should be your top priority. Before all else, seek medical treatment for your injuries. This medical attention will also serve as crucial documentation of your injury when it comes time to present your case to an insurance company. After seeking initial treatment, contact the Law Offices of Mike F. O’Brien before contacting insurance companies. Our firm will work diligently to take control over any and all communication with insurance companies and will coordinate your medical treatments so you can focus on what matters: resting and recovering from your injuries.
